Indian HC permits parties to hold ‘Heroes Day’ meeting

Madras HCThe Madras High Court has permitted the Dravidar Viduthalai Kazhagam to hold a meeting to commemorate the ‘heroes’ who had laid down their lives during the Eelam war between 1989 and 2009 in Sri Lanka, at Kolathur town in Mettur, Salem, on November 27.

C Ramamurthy, town secretary of the DVK, submitted in his writ petition that he was conducting the commemorative meeting on November 27 for the past 10 years. When he applied for permission on November 6 last, the local police refused permission on November 19.

Passing final orders, Justice MM Sundresh quoted the orders passed by this court on similar petitions, based on SC rulings.

The same could be made applicable to the case on hand. Sec. 32 (2) of TN police Act is only regulatory in nature and there could not be a blanket prohibition on any meeting. Petitioner is proposing to hold the meeting in a private land, the Judge pointed out and allowed the plea.

Allowing another writ petition from P Bharathi of Sethiathope in Cuddalore district, a functionary of Naam Thamizhar Katchi, the Judge directed the local police to grant permission to conduct a meeting on Palanisamy grounds in Alamoor on November 27.
